I know a person who had this done and am interested in whether or not there is an case law supporting that it is illegal or otherwise.

As far as I know, you can ONLY cut the BRANCHES that are on your side of the property line. Otherwise, it is trespassing and assault on anothers propery. I think that a lot of this would depend on WHY you want to cut down the tree... safety, electricty, view, etc? Generally, you CANNOT affect a neighbors yard without his express permission.

Of course. If it weren't illegal anyone could chop down anyone else's tree.

I would think it's property damage and tresspassing.
