ive been in and out of courts for 5 years now and each time he turns up with no solicitor and nothing gets done .Hes well aware of this and now im in court for divorce in november(im in ireland) and i cant get a straight answer from my solicitor , she says she cant guarantee anything .i need to know if i can get a decree of divorce without him having legal represntation.

I also think you can get a divorce after you have been separated for 5 years when I got my divorce my x did not have a solicitor I had no problem and it was before we had been apart for 5 years. Are you happy with your solicitor as she dose not seem to be helping you very much maybe its time to change it will not hold up your divorce good luck

I thought that it was automatic divorce after seperation for a minimum 2 years!! although u say ireland perhaps the law is different over there

My understanding was that you needed him to agree to divorce after 2 years, but not after 5 years.

I know that is the case under Scots Law, not sure abt England and Wales.

I think you can ,but you may have to prove that he has had reasonable opportunity to obtain legal representation..
