there is no time limit on when the funds needs to be transferred. If you have not received the money, the court system wants you to take them back to court.

uhh there are no winnings, here's how it works though:

i assume your brother won a civil lawsuit

even if he won at the trial level, the defendant has the right to an appeal, this can often take several months if the defendant has indeed filed an appeal, the court will not require the defendant to pay in some cases until the appeals court has ruled

even then, a case can sometimes be appealed to a state supreme court or even the u.s. supreme court and this could delay things even further

additionally, if your brother was part of a class action and the suit has been decided, often judges will hold up making an award until the attorneys have a chance to submit memoranda on monetary damages

even some civil cases are held up by a judge who wants to know just exactly what was lost and what the plaintiff is entitled to as a matter of law

without more specifics i can only tell you that the court will decide when the money is to be paid

also, if you have a defendant who doesnt volutarily pay a judgment then it is up to the plaintiff to enforce the judgment on his own, he can do this by seizing bank accounts, cash, property or other tangible or intangible assets through what is called a writ of fieri facias, which is a court order to seize property

hope this helps

It depends on whether or not the loosing party has filed or is filing an appeal.
If an appeal is filed it could take years depending on how long thier lawyer drags it out.
The only good thing is that they can only file an appeal once. After they loose the appeal any obligations to the winning party must be met within a specific time frame that the court establishes.
Your brother needs to ask his lawyer what is going on. He is the only one that will have that answer.
