My mom died in a house fire and my brothers and I had a lawyer,but he stated some bull about other lawyers and fire marshals. so he stated he would take the case he got scared. Where do I get the report?

Sorry for your loss. Best bet is to find another attorney. And if you first attorney seems to have done something unethical, report him to the local bar. You may want to consult with a new attorney before you do that.

In many communities, the Fire Investigator works for the Fire Department but has police powers - e.g. to carry a firearm, to make arrests, etc. If not available, the Fire Marshal or the Incident Commander (usually the Engine Officer) most often takes responsibility for investigating the cause of the fire. In any case, especially where there is a death involved, the official investigaton by law will be performed by a person with a *vast* amount of fire experience.

However, insurance companies will often conduct their own investigation, using their own employees or an independent contractor who is *supposed* to be fluent in building codes and the behavior of fire.

There should be a report you can inspect at City Hall; please do so ASAP.

I have never heard of an attorney getting scared, I have heard of them not being able to handle certain cases outside of thier expertise.

Fire investigators will be either from the police or fire department and will have badges and ID. Or they will be from the insurance company and also have business card and can be verified by the insurnace company.

fire marshals merely look at the fire and determine the cause of the fire and a police investigator will determine the cause of death.

From the fire department and the police department. Both departments will have files on the case. Ask them, they have to give it to you.
