You are responsible to pay what they say in the settlement. So if it includes arrears, yes. It's rare that they will let you out of any past due amounts. It would have to be extreme circumstances and they figure, if you didn't let us know of a big change in things when it happened, then tough! Say like you lost your job. The first thing you do, if you have achild support payment, even before you go to the unemployment line, is you call a lawyer so you can make new arrangements or at least let the court know. That way, if your straight up with the court they will be fairer with you. What I've seen with arrears is that the court makes you pay a down payment, say to get your drivers license back, and then just ups your monthly support payment to catch you up.

Being behind is also contempt of court.

depends on the state your in the kind of settlement your receiving how far behind you are if child support enforcement even knows about the settlement and has the right paper work to have you garnished then yes they can take everything they are owed however if your not alot behind they may not have went that far
