It really depends on your definition of lawsuit. As anyone with two children knows, one is constantly mediating disputes between them, evaluating evidence, and passing and enforcing judgment. So the first time two people appealed to authority for help resolving a dispute is probably the first time a woman had more than one child.
Nomadic tribes that exist today have methods of dispute resolution. The earliest societies had priestly and secular authorities that heard complaints and passed judgment.
