Depends on where you live. In North America you can do a cover cd as long as you show the credits on the cd liner and register the use of the song. If you're doing it independently, you'll have to show how many cds you sold and the royalties, if any apply, will be collected by the guild and distributed accordingly. If you're going through a record company and producer, then they'll do all the leg work. Call the musicians union nearest you and ask who you should contact.

I wouldn't worry about it. Until you are selling 10,000 plus units or more then it is not worth their time money and trouble to bother with you. If they even find out. If you did get the rights you would probably never recoup. Just give credit where it's due. Somebody said "if they pick up your record" well that doesn't sound like the intention. You are a cover band and if you only want to hand sell the discs at shows, you shouln't have any problem.
