I'm wanting to run a personal ad basically telling the public that she is in adulterous and that her and her paramour commited adultery. She is so smug and shows no remorse and he has cut and ran. Vendictive yes. She did it just before our aniversary of 14 years and it hurts like hell. It seemed almost intentional and she still does things and says things that are hurtful. She is making me out to be the bad guy to her family and friends. I just want them to know because I think It's payback time.

Well, the only thing that I'm certain of is that you would not be committing libel. Truth is an absolute defense. You can print anything true about anybody.

That being said, I doubt any newspaper would take your money. Newspapers have standards as to what ads they will accept and this is probably way, way outside their standards of decency, true or not. They won't print your ad so stop worrying about it.

But that's not the biggest reason not to go through with it. The biggest reason is that printing such an ad will reflect far, far more poorly on you than on your wife. Your wife did something bad in private that hurt you. You are planning to do something bad in public with no other purpose but to hurt her. And every single person who sees that ad will know that about you.

They will consider you immature and vindictive. They will think you are mean and churlish. They will laugh at you. And they will not forget.

Consider that your good reputation is formed by your actions. Your reputation is now in grave danger from your own actions.

Think again and abandon your childish plot.

Better person aside, anything part of court records that aren't sealed are public record right. So if she said it, its not libel. I think you could still be sued for it though. Life, liberty and the pursuit of happiness as such. You can't print something to intentionally hurt someone. Have sex with her best friend, or pick up a woman much younger than her that should make you feel better.

First of all I would like to say that I think running a personal ad is not a good idea. Move on.

Lible relates to the spreading of lies. If she has admitted in court that she did this then you can not be sued for lible for running a personal ad. However, I would be willing to bet there would be some other grounds she could use to sue you.

Libel is stating a falsehood. If she is an adulterer, you'd need evidence to prove that. Sounds like you are better off without an unfaithful spouse. You can state the truth to her family and friends but you should have proof. Revenge will also hurt you so think about the consequences.

You can't be sued for libel if what you say is true and can be proven. However, don't do this. It's childish, and believe me, people with think far less of you for doing something like that. Just get on with your life.

Remember, the best revenge is living well.

I worked in the advertising department of a newspaper for years, and any decent paper will not let you run an ad like that. To protect you, and themselves. My ex did the same thing, and I know it hurts, but doing something like that is not going to help any. It takes time to heal, and one day you will feel better.

You have to be careful in how you approach this. Cite the public record (as court transcripts are public record) but research libel laws to assure your footing.

Considering how litigatious this country is, you could get sued anyway.

I think that you could be sued for slander for degratting the person especially by running a personal ad

I don't think running a personal ad of this nature will prove to anyone that you're the better person.

And yes, she can sue you for defamation of character and slander.

You're just angry right now and you DO have every reason to be. Do you really want to do that? What is the point of it? If it were me, I'd just let it go. Remember... what goes around, comes around. It does - I am seeing it right now with my ex who not only liked to smack me around, but cheated on me also.
