(Irish law) I wanted to sue someone for setting up a message board [visible to the public] ridiculing me for having mental health problems. I've been old that unless they have libelled me I can't sue them just because I'm upset about it, and that if I am upset I should tell the board administrator ...
And how will that help, exactly?
I've complained to the website people who told the BA that I'd complained and she told the members of the board and subjected me to more ridicule ...
Has anyone in Ireland every sued someone else for emotional distress??

Erm, aren't there new laws about cyber abuse in Yerp?? Anyone got any info on that?

Foo Fighter.. I already contacted the site owners because the board is in breach of 3 counts of their terms of use policy - they re-worded the ToU and told the board admin that I'd reported them...

BTW Slander is spoken, libel is written.

You should consult a solicitor. A lot of solicitors will give you a free hour consultation or look on legal websites, they should be able to help. Even if you can't sue them you should be able to get a Court order to get them remove this information about you. I'm sure there is something in the Data Protection Act that protects you. If they are using ANY personal identifiable information, including your name, you should be able to sue them under that act.
The other place to try is their ombudsman or, if they are not a company governed by anyone, the Internet Watch Foundation. They should be able to uphold your complaint.
Anyway, good luck and i really hope you persue this. People running these type of websites should be stopped as it is not fair for them to use information about to ridicule you.

Im not sure about in the republic, but in the uk you cant sue for emotional distress. Needs to be a recognised form of psychiatric injury, cant remember the case but it says that distress is not enough. I'd just say complain to the website people. Tell them that they have a duty to monitor the forums to stop forums being set up soley for abusive reasons. I'd also keep a close eye on the forum to make sure you dont get libelled. The second you are, make sure they pull the defamous statement straight away. If they dont then you maybe able to act and claim compensation against that. But not for emotional distress i'm afraid

There are very isolated instances where you can sue for distress, but in this case your remedy lies in

1. libel, you have to prove the damage to your reputuation etc, and the lack of truth in any statement made on the website. Your damage can include some kind of mental fear resulting from the libelous remarks,

Your best bet would be to see a irish solicitor, if they are called that over there.

The message board cannot be held liable unless the person is either posting pics of you without permission or giving out your personal information, such as phone number, address, etc. Of course I'm not too familiar with Irish law, so I am saying all of this based on law in the US, which may have some universal traits.

In the US slander is classified as untrue information distributed with the intent of defamation. So, if it is outright untrue stuff you have a case. If they are just calling you names, the only thing you can do is call them names right back.

i am sick of people suing for things like "emotional distress" I'm sorry but i think it is pathetic. unless you have been unfairly sacked or injured through someone elses' neglect, it is ridiculous. grow some thicker skin, ignore it and rise above it. what is the world coming to when you can sue someone just cos they upset you!!!

Is it possible that your neighbors trapped your cats because they caused your neighbors distress in the first place, by messing up their lawn/plants, stealing food from their kitchen, etc? Be careful, they could counter-sue you eventually.

life is emotional distress so ignore it and get over it, worse things happen to people everyday
