According to New York State laws, how do I LEGALLY evict someone who has been living with me for over 30 days??? The person is working and has a steady income if that helps any.

I'm not the landlord but I'm the only person on the lease, his name isn't on the lease and technically, he should not be living with me.

That depends--are you the landlord or is this a roommate situation? If you are the landlord, consult the Department of Housing and Community Renewal's website http://www.dhcr.state.ny.us/ for what you are legally allowed to do. If you are a roommate, is your name on the lease for the apt/house that you are renting? And is it allowed to have roommates according to your lease? If yes, then you can give notice (whatever you think is reasonable) that this person must leave. If this person is not paying rent or a part of the rent, then you have the right to ask them to leave at any time. If they refuse, you can call the police and have them escorted out for trespassing.
