I bought an import phone from a T-Mobile store in the mall. They were advertising it with iTunes, that's the whole reason I bought it. And since it's an import phone, there are no refunds or exchanges.
So I take it home, and there's no iTunes on it at all, or any mention of it in the directions.
I went back to the store 3 different times to ask them what I should do, and they said to call customer service and have it downloaded, that I could access it with my memory card... A BUNCH OF CRAP THAT DIDN'T WORK, long story short.
So I called there today to talk with the manager, and he said, "well when we say iTunes, we mean digital audio player." But I argued, "those aren't the same things, and your employees have been telling me otherwise!" He said he didn't know what to tell me, that I'm stuck with the phone.
I'm so pissed off! They sold me a phone, said it would have iTunes, and it f-ing doesn't and they won't give me a refund! What do I do?!

I agree with the lawsuit for "false advertising." That will get them to do something. Good luck to you.

Would this happen to have been a motorola SLVR? The only version of that phone that has iTunes is the one produced (and locked to) Cingular. T-Mobile does not carry the iTunes SLVR, and neither does any other carrier in the world.

I'm sorry, but it sounds like you are out of luck. Your only other option is to mod the phone and put iTunes on it, but it requires a lot of computer skill. Try motomodders for some help on this.

Call T-Mobile corporate office at 1-800-318-9270. Insist on speaking to someone in the corporate office. If the operator gives you any grief, toss around the terms "lawyer", "false advertisement", "local news", etc.

If you don't get satisfaction there, file a complaint at the Better Business Bureau, http://www.bbb.com. That should get a response.

Go up to the next step. Get a hold of the the next person about the manager and complain. Mention a lawsuit for "false advertising." That should get them working on that for you! And if all else fails, actually sue them. You will probably win the case, in which case, you won't have to pay any court costs, they would have to pay. Good luck!

Well here's the deal. Did they distabute advertisements for the product. If they did you can get them for false advertisement and get the cost of your phone back. No that dosen't include anytime off work or pain and suffering or nothing, you can't get it. Or you can suck it up and learn from you mistake. You can go to an "official" T-moblie ( I think that is what you said) store and get a new phone. There is "stores" out there that sell the products and can get you service through any phone company and sell you there phones. Although they have nothing to do with that company.

You can buy sell phones one e-bay and resale them if you wish and thats what a lot of company's do with them. email me if you have any more questions

You should go back, and complain to the manager in person. Threaten him that your planning on filing a complaint to the corporation and tell him he's commiting fraud. It's much easier to say no over the phone than in person. Talk to the Manager, the employees usually don't care. And if that don't work, then you can try making a scene.

That usually does it. However if they're being shady about it, you can threaten to sue!

That is called False Advertising. You need to call a Lawyer. Have a copy of the ad for proof and sue T-Mobile. You will be able to afford lots of Cell phones after you done.

Go over the manager's head, and talk to the owner of the business, and then proceed to report them to the Better Business Bureau. I would also talk to the State Attorney's office. And even let this business know who you are talking with, BBB or Attorney's office. If they are threatened in any way, they might change how they treated you. Good luck!

Tell them you are going to contact their corporate offices. Then actually do it. If you can't get anywhere with their corporate office then call the better business bureau. Their salespeople mislead you. Make sure you document all conversations that you had and when so that way you sound like you have prepared and done your research. An informed consumer often gets their way!
