Well, let's see. If the guy signed the birth certificate and has been in the child's life since birth plus a number of years, then to the court system, he is the child's father. The next situation would be the signing of the child support papers. If the assumed father does not protest paternity at the hearing and signs the papers, then he is legally the father of the child. As the previous person stated, adoption is another situation. In some states, you can always have a paternity test done and it is up to the court's discretion to either correct the matter or leave it be. Anything dealing with children are done in the best interest of the child. Parent's rights are put on the back burner. I don't know if this is a trivia question, or a real one, but I hope this answered your question.

In most states, the husband of the mother is legally presumed to be the father, so unless another person is proven to be the father, the husband would be legally considered the father even though that fact is not proven.

by the laws of that state, for example a man in some states who is listed on the birth certificate and remains on it for a certain number of years, is legally the father even if DNA latter proves him not to be,
Got to love the stupid laws in some states.
If the jugde did not follow the laws in your state the ruling can be appealed

My son's father never showed up for paternity test and since he didn't show they say he was not denying it was his son. He did not show up 2 times!! I wish he wasn't the dad but...........crap happens!!!!
Also, if you signed the birth certificate....that could have an effect also.

because the laws cant keep up with people, if you are married in some states, you are the legal father if if she is a raging whore, and tells you it aint yours.
