It all depends on if the phone already has a plan on it, or if it's just a phone with nothing. If it already has a plan on it, the plan would have to be Cingular.
If the phone has no plan on it, I would try selling it on Ebay to get the money to buy a new phone.

If you got it from a Cingular corporate store you have 30 days to do an exchange. Turn it back in and get something else within 30 days with no problems

I am a cingular employee at a company retail owned store...that phone is online only...and you can only exchange for the same...you will have to go through customer service to exchange it. They wont do it in store.

Yes u have 30 days to try the phone weather its been opened or not.Simply return it and exchange or upgrade that phone with no ?s asked.I have cingular and have done that before.Hope i helped you. :)
