My husband has faithfully paid child maintenance for the past 8 years without fail and on time (which I believe is his dues). There are presently problems with the step father and we would like the youngest child to come and live with us but wonder if anyone knows if her mother (who works full time) will have to contribute to us in child maintenance?

Child maintenance is paid by the non-custodial parent to the custodial parent to assist with upkeep of the child. They mom can pay, just like the dad does.

Both parents are financially responsible for thier children. It's just that when a mother keeps a child, she is already contributing. Also, when a father keeps the child, the woman may not be able to provide much child support. But she is responsible to pay in accordance with her income. Also, the formula used depends on what state(s) you, the child, and the parents are in.

Your husband will have to get a court order which means going to court and getting custody of the child. At this time the court will assess both your income and hers and than declare the amount she has to pay. Generally the non-custodial parent pays child support to the custodial parents regardless of sex but there has to be a court order. Generally the custodial parent is the mom that is why there are not really any women who pay child support.

Are you talking about your stepchild? I always thought maintenance was only for fathers (I may be wrong). If so, maybe you can encourage the mother to help out regularly with financial needs. If she is having problems with her new husband, it may affect her pocket. I am sure you can get more information from a legal expert and of course the www. See the following sites:

It varies from State to State, but in most States the non-custodial parent is required to pay child support (maintenance). I've been on both ends, it is much cheaper to pay child support than it is to be the custodial parent.

yes she will csa will help despite there problems. She will have to pay you 15% of her income if she is married and he works his wages will be taken into concideration. If there are any other children living with them the sum will be reduced and there financial situation will be considered. But i would try and get a private arrangement after the child comes to you and mention csa they might just cough up if there worried. Dont give up csa might take a long time but they will get you backpay from the date they first contact her, they will take the money directly from her employer if she is not self employed . Obviously she has to be able to live but i would def give it a go. good luck

Yes she has to pay child support and to not pursue it would not be fair to your child. Besides its the law. Go to Domestic Relations and file a petition for child support. then they will set a hearing date and both mom and dad will have to attend. If the respondent does not attend then an order will be set in the petitioners favor. Bring proof of your income vs her income and bring an attorney she has to contribute both financially and medically usually half and half. it depends on where you live.

My husband has custody of his and his ex-wife's three children and she is ordered to pay a certain amount each week. She hasn't paid very much in four years and the court is now going after her house and car and anything else she owns to get her debt paid.

If the husband is awarded custody of the child, the mother must pay child support.
