my business law teacher in college always told us to think of the "deep pocket" rule, meaning only sue people that have money. but unless you signed a CONTRACT with your employer, then your employer is not at fault, nor is he/she liable for reinstatement. find out if your state is an "at will" state as far as employment is concerned. if it is(as is the case in (i believe) 34 states), then you are screwed.
if what you are seeking is REVENGE, then do this: file a small claims lawsuit against her(costing you b/w $35-$70 to file), but be careful about how you come up with the number you are suing for. if and ONLY IF you can prove that she lied, then i THINK that you should sue her for 6 months of wages, since that is generally how long it takes to find a job (ie unemployment insurance lasts 6 months). don't say ANYTHING about defamation of character in small claims court, this area ONLY applies to people in the public eye, ie politicians. just focus on how HER LIE LED TO YOU LOSING MONEY. if you can prove that, you will win.
what happened to you is bullshit, but you can't really DO anything about it other than really just harass the lady. even if you win in small claims, she won't pay you. you would have to get a judgement against her, then garnish her wages, etc, which BELIEVE ME is not worth doing. so if it is revenge you seek, sue her. if you want money, then find another job and use a friend as a reference for your last job. if you are pissed off, i've found that throwing eggs is a good outlet for hostility.

What you can legally do is get a new lawyer - immediately, honey. You were wrongfully dismissed. This individual has absolutely no case - it's a she-said, she-said scenario. When did these alleged incidents occur? Did she have any witnesses? Even if you don't work their anymore, can you find someone at that workplace to back you up? You could sue for defamation and you could sue your work for wrongful dismissal.
Also, stay away from that lady, no matter how hard it is. She's probably expecting you to snap and assault her - which would advance her case.

First thing you need to do is find another lawyer. If she did not file a criminal complaint of assult, she has no proof. It sounds like it's a he said/she said type of issue. Where there any witnesses to the assult? If not, she doesn't have much to go on. You do need to find another lawyer who can advise you of your rights, and see if you have a case to counter sue her and your former employer. If this is a false accusation, don't let the employer off the hook. Good luck.

Wait till someone else gets hired. Repeat with someone ELSE you don't like. edit: think about it- with you constantly picking up the slack for the new workers, your manager will think of you as "loyal" and a "hard worker". He may even give you a small raise and a "managerial position". In other words, keep up the good work- you've just found an elevator next to the loooooong ladder to middle management.

a lie detector test will make the Truth come out, oh and if she was hospitalized she needs to have records, sounds like u need to call other lawyers because if your Innocent like you say you are, than someone Will defend you!, and if not,than go shoot her, i know someone would defend you then
