He pays child support wheather or not he sees the kid. If the kid doesnt wanna go, they dont have to. However each state has a different set of rules about it. You should consult your attorney or social worker.

Legally, I'm not sure if the rules change state to state on the age a child can choose - but I would imagne that would have been covered in the custody hearings.

My parents got divorced when I was about 9, my dad got custody my mom was and still is an alcoholic. She never paid child support and basically disappeared. She moved around a lot and settled a few states away from her five kids. The trip was far, expensive and inconvenient, my mom's mental state was unstable, intoxicated and hateful and none of us ever wanted to go see her. But, now that I am older (25) I am glad my dad made us go (even though he didn't want us to) because we learned for ourselves that our mom didn't want to have anything to do with us. We could never blame it on our dad or wonder, what if....we had spent more time....if she had the chance to get to know us.......maybe things would be different.

Every situation is different but I guess what I am trying to say is maybe you should encourage your child to see his father. It teaches forgiveness.
Sorry I couldn't answer your legal questions.
Good Luck!

get a lawyer there is laws.....kids have a voice too and im telling you this because i have seen it.if the kid does not want to go where he at she have her reasons..... they can fix it so he would have to come to where you guys are and visit, your kid should not be force.talk to a lawyer. and on top of that he is not paying??? i dont think that if he is not paying or paying still the kid does not want to go there is no way they cant make the child force the child no i dont think so. but this is something the courts are going to decide and they will fix it in the child best walfare so if the child dont want to go to where he at the visitations would be arrange in another way.just get a lawyer one even appointed by the court this is not a hard case i think even one of those public lawyers can fix this but if you can afford one go ahead and get you one.good luck.

Check with your Friend of the Court (FOC). I believe that you can get a ruling from a judge from FOC that the child does not have to attend visitation. Support should not have any affect on whether visitation is done or not.

Talk to your lawyer and find out. He also needs to be paying child support. I really dont know what the childs rights are here. Age may have something to do with it.
