My sister was court ordered to let my nephew (her son) go visit with his father for one week. His father picked him up on June 11 and was suppose to have him back on June 18th. He called and told her that he didn't have transportation or money to bring him back. (he lives in Ga. my sis lives in NC). Last year he did the same thing, My sister sent money for him to bring my nephew back. Well this man also refuses to pay child support. Is there anything that can be done to him legally to get this child back in the state with his mother where he lives?

A good friend of mine is going thru a similar situation in CA. It is so stupid that the courts let the "deadbeat father" visit their children, especially if the dad is not paying child support. If this man (I use the term loosely) is not financially supporting his flesh and blood, then he doesnt deserve to even talk to the child. I was also under the impression that the dad had to have the child back to the mom, especially when the Mom has full custody of the child at the pre-arranged time, unless the Mom made prior arrangements with the dad in advanced, I could be wrong, but thats what I thought

yes! he is in violation of a court order, demand that the order be enforced...call the police and find out how you go about getting that done. how does he refuse to pay child support? they put you in jail for that these days. i'd definitely work on getting that order changed when she gets him back, especially if he's done this twice already, he's shown that he isn't up to the responsibility granted him by the court and therefore shouldn't be allowed to have it, especially since he is being taken out of state by this guy. does he only see him one week a year? that would be another strike against him with the courts. a guy like this isn't giving anything good to the child anyway. good luck this is a terrible situation and i'd be ready to kill someone if they took my son and didn't bring him back!!

Yes there is! That is considered kidnapping in california. I don't know what state you are in but she needs to go to the courthouse and get papers and file an exparta hearing and have all of it changed becuase of what he keeps doing. Or go get an attorney. If he can't afford to send him back then he can't afford to defend himself in court with an attorney. She needs to get a mean one and get supervised visits to where he can;t take him anywhere.

Violate him on the court order. He will be arrested, which, if he isn't paying child support, will be an improvement.

I am pretty sure that she can go to local authorities and it is considered the same as kidnapping. He is probably just playing games with her anyway to see how far he can push her and how much he can get away with. Tell her to go talk to someone at the sheriff's dept. They will probably be able to help her.

Call the Feds and tell them he is keeping the kid illegally, and that he is breaking the Judges direct court orders, And let me tell you Judges don't like it when you disobey their orders

how about they move closer together so that the child can see both parents equally,, its about the child and not the selfish parents
