If you hit a parked car, you are at fault. The law requires you to be in full control of the vehicle at all times. It does not matter if the struck vehicle was parked legally or in the middle of the road, you are supposed to be able to control your vehicle to avoid it!

The car is parked illegally and so it is not the driver of the parked car that is at falut it is the driver ot the car the hit it. Now the parked car can only receive a citation for the illegal parking...that's it.
Now a different scenario,. iof the illegal car parked causes an accident becasue it is over a hill and can;t be seen until you come upon the hill then the parked car is liable ofr your damages even though, it is parked becasue it obstructs traffic and caused an accident.

If you hit a fixed object such as a parked car, then it is your fault. But, it also depends on how the car was illegally parked. More than likely you may just get the parked cars owner a violation too. But in the end , you hit a fixed object, so you are still at fault.

I would think it would be the illegally parked car. Of course if you were drinking while driving, or proven to be speeding, driving without a license, etc, they would nab you for that, and the other car for a parking violation and causing an accident..

Depends....If the car was parked in the middle of the road then technically its thei fault. or if they were parked on the corner of a busy intersection where the line was drawn red, then it would be their cuz you made a turn and couldnt avoid it.
