I entered into an auction on ebay for a car. Was contacted about paying for it. Sent the money via western union and then found out that someone stole my info off of ebay.Hence I have lost $700.00.
And now am afraid what other info this person might have against me.Is there anything that I can do from a legal standpoint?

Most other items are covered up to $200 (minus a $25 processing fee) with eBay's standard purchase protection program. eBay's Standard Purchase Protection Program reimburses buyers for eligible transactions when:

An item was not received.

An item was received but significantly not as described.

You'll be reimbursed up to a maximum of $200 (less $25 to cover processing costs).

In some situations you may want to contact law enforcement to report suspicious activity.

Some options include the following:

File a complaint with the Internet Fraud Complaint Center.

File a report with the U.S. Postal Inspection Service.

Contact a law enforcement agency in your location or the seller's location.

The Vehicle Purchase Protection program protects your vehicle purchase against fraud and material misrepresentation. This program is provided by eBay Motors for FREE on all eligible transactions completed on the eBay Motors site. There's no sign-up, opt-in, or registration necessary. Your vehicle purchase is protected for up to $20,000 or the vehicle purchase price, whichever is lower.

Western Union does not offer buyer protection, so I would try to go through Ebay.

i do not believe you have any recourse against eBay itself. they have a big disclaimer re: "buyer beware" and suggest the use of paypal on every auction. i am not sure i understand how your info being stolen cost you the $700... did you not complete the transaction through the auction site and instead direct with the seller through outside email? did they hijack your email address? check with your email administrator to see if they can find any evidence of tampering with your account (i.e. was it hijacked). also, if by "info" you mean any bank or credit card info, you will need to notify your account holders (the bank you wired the cash from via western union, your credit card companies) and cancel your accounts if you feel these accounts have been compromised in any way.

the amount lost would only be actionable through the small claims court system as suggested above. I also agree that paypal i the safest way to pay for any eBay auction item, and if the seller will not agree to paypal payment, then its a pretty good bet that they are not on the level.

I know e-bay has a complaint nad fraud department. Have contacted E-bay about this individual? I would consult a lawyer about this matter and also,Here is the answer 7. on the western union website.


7. What can I do if I suspect fraud or am a victim of fraud?


If you have just sent a money transfer transaction and suspect that you may be a victim of fraud, ask the sales clerk to stop your transaction immediately or call Western Union. If the transfer has not been completed, your principal and fees will be refunded.


Contact your State Attorney General's Office of Consumer Affairs if you are uncertain or suspicious of a telephone, mail or email solicitation.


If you feel you have been the victim of fraud, you can access the Internet Fraud Complaint Center (IFCC) at http://www.ifccfbi.gov/ or contact the Federal Trade Commission through their web site at http://www.ftc.gov/.

Your statement seems lacking in information. You say that someone stole your information and you lost your money, yet there are no specifics as to how you lost the money. Sounds to me like you found a bad seller that ripped you off and ebay can hardly be held responsible for that.

ebay warns all the tiem not to use western union. so I am sorry to be of bearer of bad news, but you cannot recover the money.

hindsight i would have suggested using paypal then you could have gotten your money back
