My spouse is wanting to take off work a couple of weeks early due to expecting a baby. She has already filed her paperwork under FMLA. Can she take off to prepare for birth? Her employer is denying her to take off earlier.

HAHA. I am going through this. I don't even qualify for FMLA because I haven't been at my place of employment for a year yet. I know that you can't take off with FMLA until you actually give birth or if you are put on bed rest. See if her OB will put her on bed rest for a couple of weeks! Maybe he/she will maybe not but in all reality that is the only way that she can get things ready. Unless she has vacation time. I am due a month after I get my vacation so I am taking my vaca before I put in for my short term disability. All you can do is try.

That's BS. Have her ob/gyn or midwife write her a note saying it's "medically necessary" for her to take off work now. Her employer can't do anything about that...it would be breaking the law.

HOWEVER, if your wife is "OK" meaning she's not having any problems and is still able to work and stay healthy, you should tell her to think about taking time off now. The more time she takes off now, the less time she'll have to stay home with your baby when s/he is born.

I think the only way she could actually take off early and guarantee she has a job when she comes back is to obtain a doctors note. If she has any vacation time she could use that to get the time off.

it does depend on the state, i owrk in NJ and legally i can leave 4 weeks before and 6 weeks after. i would look into your states short term disability laws are, what state do u live in?? most of the time you should be able to leave a few weeks early

Unless she isn't feeling well -- why not save the time to enjoy the baby when it comes. Preparations can always be done on the weekends.

yes she can I took my last two weeks off and ending up having to take the next 6 mos off too (premature baby had to stay in hospital a couple of hours from home....I stayed too)

She would have to have a medical reason from the doctor. But good luck on the baby anyway!

i wanted to work right up till 6 days before giving birth, but my doctor put me off on a doctors certificate, as my blood pressure was high, and i had swollen angles, he said to me i need to stop now. and gave me a certificate, and they was nothing work could say to me, but to accept it. he gave it to me, 2 week before i was due.

yes she can take 6 weeks b4 her EDD thats amount of time materinty leave, if she needs longer time then she should get a doc cert from her obgyn
