I would say that it is disrespectful. I would be angry if someone did that to me. I'm allergic to cig smoke and can not tolerate secondary smoke either!....

It is assault PC 240 and also battery PC 242 here in California. Assault is the apprehension of harm and battery is unconsented physical contact. The smoke it not air but particulates and thus these particulates making contact with a person s body is battery.
