I need a sample of his blood to be able to do a DNA test to prove that he is the father for legal reasons. Does anyone know if I need to hire a lawyer? or if I can request it personally from the crime lab? I am so upset and stressed about his death and on top of everything, I am not getting straight answers fromt he police and sheriffs. I would personally hire a lawyer. That way you can get things done legally and faster. Is the father's name on the birth certificate? If it is all you need to do is go down to the Social Security office and show proof so that your child can receive death benefits. I am sorry to hear of your loss. My step-son's mother past away last year and we had to do a lot of paper work. Take care and everything will work in your favor.

If the child is a boy, you can get the DNA for the test from the baby's grandfather. Otherwise, it is probably best for you to get a sample from the corpse. You could try asking the coroner for a sample, but you might have to see a lawyer about all this before it's over with.

I would definitiely get a lawyer ASAP! This is an awful situation and you really need someone to be on your side who knows what they are talking about.

You can also get it from his mother and father, since he is deceased. He have half of both his parentals DNA.
