Please see my earlyer Q regarding the same situation...
Now what do I do next? And how bad is it for them, and will I be ok wasting my $$$ on a lawyer or just go to small claims court and have no lawyer?

It would be nice if I new who had the most currect answer in the other Q that I posted (that way I'm also more clear on what I should do, like is it REALY an "unfair trade" some one said that). But as long as I know weather to have a lawyer involved or not, will be good enough for me. I'm not stupid so I think I can go alone in small claims court but if it gets bigger I'm pritty much doomed to pay someone else LOL. So what yall sugest and what do yall think I should do?

If you can prove that there are damages arising out of this activity, you can sue. Make sure that the advertising was done legally (i.e., check that your fliers are not against applicable zoning laws) because bringing any claims. If you want to be awarded damages, you will need to come up with a definite quantifiable amount arising out of such activities (and be prepared to defend that amount).

What about more effective advertising? Your damages probably don't exceed $100 -- less than you'll pay for a court battle. For that amount, you can put several ads in a local newspaper, for example.

Is this board a community "anybody" can post type board? If that's the case unless the owner of the board says you can't remove others postings then there's really not much of a case. You don't own the board and thus can't sue for destruction of property. On the other hand if there is rules for posting on this board and they are violating them then they could "possibly" be sued if they are violating them. Bottom line is that unless you have a contract to use the space for posting then there's nothing protecting that use.

Why small claims? What is the total damage? Small claims has a cap on it.$5000 and less. You have discussed it with them? You have evidence to prove your case?A higher court means the possibility of higher payout. Small claims is good for making a point though.You can file a complaint with the police also. Have you discussed dividing the territory?

Well I'm not gonna pretend to know the law, but if this business is big enough to sue for damages, go for it, and yes, if you can catch them in the act, "make sure and have someone with you for a witness", get the law involved, if they are found guilty of a misdemeanor crime, you should have no problem winning a civil suit.
