My mother lives in NC with her husband and 4 year old child. Her husband took off wednesday without any clothes, took her and is refusing to let her talk to anyone but his family. He has taken her to NY and there is no formal court dates for custody.

Is there anyhting that we can do to get her back ...
Can we just go there and get her since we have 50% custody?

Can he get in trouble for taking her out of NC without telling my mom?

Yes he could get in a lot of trouble...This needs to be handled through the courts...Your mom needs to go to the police station and file a missing persons report now...

Get an attorney at once. Unless there is provision in a court order, he also has 50% custody. You will probably have to sue for full custody, and in the meantime, he's probably already consulted an attorney. You want to make sure the suit is heard in YOUR court, not in NY. Get cracking tomorrow morning ASAP!

Most states have laws that regard this as child stealing. It's not the same as kidnapping. It's when one parent takes a child from the other and intends to continue to deprive the other parent of the child. Police departments and district attorney's offices have special officers to handle these kinds of complaints. Best to call a law enforcement agency in the jurisdiction of the child's home and ask if they can help.

No he did not break the law since there is no formal custody order.You need to call and make an appointment with your local child support rep at the dept of social services

You have to check the laws in the state u live. in california when there is no custody set they have 50/50 cusody. take the cops with you and have her removed, however they might put her in foster care till they figure it out.

just leave it up to GOD he knows the right place for if her if try to go get her he may have a weapon so plan a court day for full&and legal custody
