Yes it's illegal in all 50 states and all of the US territories as this "under the table" practice is against a federal law, even more so if you are an illegal immigrant. Check with the IRS for more info.

Being paid "under the table" is considered illegal throughout the U.S. Both you and your "employer" can get in trouble since you're obviously not planning on reporting that income on your tax forms. If he's not willing to pay your taxes, he should consider 1099ing you at the end of the year. Then you should plan on paying approximately 22% against the monies you've earned.

"Under the table" means to pay someone withput reporting it to the government. No taxes are withheld and no social sercurity, unemployeement and other taxes paid. It is illiegal everywhere. But you and your employer could be in trouble, as you also have a responsiblity to report the income to the government.

The reason some employers pay people under the table is so they don't have to pay insurance and taxes on them. Plus they don,t have to pay overtime. So I would imagine it is illigal in California.
