It depends on the contract the employee has with his employer. I have seen contracts where anything over 35 hours in a calendar week was paid at the overtime rate. If there isn't a written contract, then the answer depends on the labor laws, both state and federal. Consult a labor lawyer for further details.

You will need to check your states labor commission, but if I recall correctly, any time over 40 hours in any 7 day period is required to pay 1 1/2 time.

Tips only? there's no overtime. But salary plus tips, overtime must begin after 8 hrs day, 40 hrs week--unless you are hired in a management position. In which case, no overtime.

A TIPPED EMPLOYEE HAVE TO WORK FOR 9-9 IT MEANS 8 HOURS AND IN IT 1 HOUR FOR LUCH BRACK IT MEANS 7 HOURS ONLY
