I was in service in 1993 a soldier according to police report was driving a 5ton truck to fast for road condetions and rolled it while trying to make a right turn. I was in the rear and was thrown and hit my head upon impact hemmoraging my brain and shattered my right elbow and broke my foot in 6 places. I was released in 1994 on Tempoary disability till 1995 i was retired at 40% of a E-3 $400.00 a month.

come to find out through going over medical records and paper work that there was alot of screw ups. like trying to have me re learn to walk for two weeks before they relized i had 6 broken bones in my foot. Had me sign paper work that had to do with my discharge only 2 weeks after i awoken and could not even walk nor talk nor sign the paper correctly but yet had me do so.

Since then i been struggling for right medical care finiancial care and found out that the soldier that caused the accident just retired a few years ago. i struggled to live and he lived with none.

It is unlikely you will find a lawyer who would take the case, but you should contact local lawyers and ask them. Most lawyers will consult with you for no fee before deciding to take a case.

Suing the government is very difficult, time consuming and expensive. Even if you prevailed (unlikely), it would be ten years (minimum) before you did so.

Good luck to you, but if I were making the decision, I would take the $400 and be happy.

It's a long shot trying to sue the ARMY i think that you've definately got a case. You need to find a civilian lawyer that either has a lot of experience with military cases, or was an Army lawyer himself. Good luck.

Yes, please do, and since the driver is now retired as well, you may be eligible to file a civil suit against him as well. Many lawyers will require a retainer to work on your case (expect a couple of thousand dollars), however I'm sure you'll be able to find a reasonable lawyer who will take on your case pro bono - meaning that you'll pay them out of your settlement. Interview many lawyers before agreeing to one, and try to find one that has a record of sticking it to the military - it will increase your chances of winning. Good luck and best wishes!

if anything, you could have a malpractice suit against the Army docs that treated you. I would get some advice from a lawyer that'll tell you the honest to god truth and not just try to take your money before going any further with it, though.

Aside from attempting to sue the Dept of Defense (nearly impossible), you can file a civil suit against the driver for his carelessness.

You may have signed a release when you joined concerning not being able to sue. Check on that.

You need a malpractice lawyer. They will work for a percentage of the award. You have a good claim.

Sorry bud, but I think I would sue the medical staff not the Army, they screwed you, not the Army.

NO!!! You cannot sue the Government because you would be sueing yourself, anyway, you're being paid for it at $400.00 per month.

The statute of limitations has probably run if it was that long ago.
