Is it true that if you have an old cassette or LP of an album that it's legal to download a digital copy of the recording from a P2P network?

Let me break this down for you: If I own an LP of the Beatles "Abbey Road", I am leagally able to make back-up copies for my own use. What is the difference if I digitize the LP myself or if I download a copy of it from the internet?

It is not legal to make that album available for downloading in the first place.
However if you do download it AND you own the album already, it can be considered "Fair Use".

the last I heard, copy right protection in the U.S. is for 100 years. after that, intellectual property becomes public domain.
in simpler terms, music, either the composition or recording has to be over 100 years old for the public to do what they want with it.

Yes it is true. You can make your own digital backup, but downloading for free is illegal.
