You can file for it and I'm sUre the courts will side with u
Whats important now is u, your 3 yr old and ur unborn child) so what u should do is not allow yourself to get stressed and please don't give him the power to get u stressed
Tell the courts u want child support and may be even spousal support. He has to take care of his kids.

Wow. Tough life, tough situation. Sorry you are going thru this.
Sounds like he is either too busy for a family or he is running away from responsibilities.
If he no longer wants to be with you, make it official. Get a lawyer to make sure he does not, a few years later, when he gets older and more mature!, shows up at your door and ask "forgive me." You do not need the mind games!!
I would also suggest that you join a parents without partners group and find someone else. There is a lot of lonely people out there looking for companionship.

In almost every case the mother wins custody unless the father can prove abuse or neglect of some kind. Since the father is so far away, it's doubtful that your child will be seeing him very much. However, as she grows up she will ask about her daddy and you should allow occasional visits. The court will decide on visitation right.

If you file for the divorce,you can seek sole-or joint custody of the children. Either way,he gets to see the kids if he is paying child support. If he has been the one supporting you and the kids,he must pay all the medical and school bills if they decide to go to college and they don't have a scholarship.

All you have to do is go file...It don't matter where he lives maybe even better...He will have to sign like you have it written up and agree or will have come back to VA. to work it out through the court...Best get it started and make sure to get enough support for the children..

You say that your husband wants a divorce, but doesn't want to file??? What is his reason??? Sounds like he is being a bit of a coward!!! Get in touch with a lawyer first off, he will guide you, that would be the best. Sounds like you're better off to move on anyway. Best of luck to you.

Unless you are a bad Mom, you will get custody, he will pay support & he will have visitation whether your child likes him or not. The best thing you can do for your child (unless her dad is abusive or something like that) is talk to her about her dad & all of his good qualities. You have 2 kids with him so he can't be that bad.

Contact your legal aid society found in the yellow pages. You may be able to get full custody and child support to boot. Good luck.

Sounds like to me he doesn't want to be a daddy, so you don't have to worry about making your child spend time w/ him.
If he wanted to be a dad, he wouldn't have moved so far away.
Take the divorce and move on!
