Fair point, mesperanto, I hadn't considered aquatic mammals. They do talk. But thumbs? The amphibians sound more likely on that score...

I'm not sure what you intended your quetsion to be.

As mesperanto pointed out fish have already veolve dinto the only intelligent race we know of. There is no reason to believe they wouldn't do so again if the opportunity presented.

Are you perhaps trying to ask if it i possible for an intelligent species to evolve in an aquatic environemnt? It is possible but very unlikely. The three dimensional nature of water makes a lot of problem solving skills redundant since all aquatic cretaures can 'fly'. Added to that fire is not possible underwater and without an external energy source there are some very severe limits on the benefits of intelligence.

As far as vocal chords go, only mammals have them so obviously fish can never be intelligent if that is a criterion for intelligence. Neithe rcna birds or amphibians or reptiles or... Of course you don't need vocal chords to communicate using sound and most fish species manage to make sound quite fine without vocal chords.

As for the ocean being a better place to be that is dubious. Oceans are just as vulnerable to change as the land.

Why should fish succeed where man has failed?

In reality, we came and evolved from fish, so the answer (making the gross assumption that man is intelligent- and I'm going out on a limb with that statement) is yes, they already have.

Plus, wouldn't you count whales and dolphins as fitting your aquatic category of intelligence?
