You have to file for a legal seperation, just as you would a divorce. It's only after you've been to court and had it adjudicated by a judge or commissioner that you can be considered legally seperated.

you are legally seperated whenever you and ur spouse is no longer living to gather. then the lawyer will take it from there and start the 1 year for seperation into you can get a divorce because u have to b seperated for a year before the divorce unless someone has the other on any grounds of seperation

It is when you have both agreed upon a date and that date gets recorded in the court system. Here in CA, a couple can be legally separated but still living together. That was my case for 2 months until I had enough money to move out. The date of legal separation is VERY important in regards to debts incurred after that date, joint assets prior to that date, etcc. After the legal date of separation, any money you guys borrow or owe after that date belongs to that person only. Unfortunately it works both ways...if you file and your spouse wins the lottery a month after the legal dos, I think you are pretty much screwed....Hope this helps!

It becomes a "legal" separation when the paperwork is filed with the courts and a divorce decree follows within 3 to 6 months. This time varies from state to state. Check with a lawyer.

It depends on the laws of where you live. I know in Canada it's different than the US. Anyway, in general, a legal separation is when there is a legal separation agreement signed. It can also be after a certain period of time. In Canada you are legally separated when you have been living separated and apart for one year.

A legal separation is called a "divorce." Don't fool around with the terminology. Why are you asking, anyway? Unless he is threatening your life or cheating on you, you should not be even considering the "d" word. Unless you are the sour grape. Don't ever marry unless you mean it. Seek legal advice if you have children and property to split. Assume nothing.

To the best of my knowledge a legal separation is when it is court recorded. If you have a restraining order against one of the persons involved, & a judge grants it; then this would be a "legal" separation. I'm sure there are others, but this is the only one I know of.

it depends on what state you're in. some states require an official separation document while some states require you to just live apart from each other. either way, you have to be separated for an x amount of time before you can file for divorce.

Well never really untill the divorce. Sepration doesnt mean anything to the courts really. Just means you or whoever wasnt with the spouse for x amount of time. But like i said it doesnt really mean anything.
