According to the Justice League TV show. Aquaman can breath both water and air. Comics seem to support this idea as well.
The only explanation that I have is that he does not use gills for breathing. He probably has some organ like lungs that he uses for both. He is super strong so forcing water in and out of his lungs would not be that big of an issue. I know that he use to only be able to stay out of the water for an hour or two because of 'drying out' and loosing consciousness.

His lungs have a way of filtering out the oxygen I suppose.
It's just a comic so you cannot rationalize it.
