my wife is addicted to persciption drugs. her dr. over last couplke of years just kept giving her more and more. child welfair has gottten involved . in a statement to them in oct 05 he stated that she was an addict. ( i have called him twice and told him to stop giving them, but he still did) after oct 05 i countuied to find scrips with his name on them. in april she had an accident with kids in car and i found a bottle with his name on it. seems to me he has made it real easy for my wife to get and stay hooked. betwween the pain killers and the coltipins he was wrong in not cutting her off. now because of all this we are devorcing. can i sue?

Yes, but the first thing you should do is contact your state's Board of Medical Examiners. They can audit the records of the physicians office and even revoke the doctors license to practice. Then, you'll have some evidence and a leg to stand on in court.

I think the question you should ask yourself is, "Is it appropriate and necessary to sue my soon to be ex-wife's doctor?"

I can't comment on her addiction, since I am not her or you. I don't know what types of medication she was taking and for what purposes or how frequently. I do think that you should think about why you want to sue. What would you or your wife gain? I mean, it was her decision to continue to ask, receive, and take the medicine. I don't think you have much of a legal case, and even if you did, you're divorcing her. It is her life alone, now, and it has been her body the entire time (although when you're married the Bible says you're "as one"). Just my thoughts. I hope you are able to make the best choice, as only you can, because you have all the info and personal experience with this, and I don't.

Way too bad for your wife huh? It wasn't HER fault her stupid doctor doesn't care enough for his patients to oversee the drug addiction coming on. Too bad for your kids too. My parents were alcoholics bad and the State of Washington came and took us away because of the neglect and abuse. But unfortunately you can't sue the doctor, but a call to the doctor when this all began should have been your first move a long time ago. My ex-husband got addicted to all sorts of downers when he was diagnosed with Krona Disease and I called the doctor right away, we got him other meds and stopped the really bad ones within a month after I noticed he was "stuck". If you would have called the doctor and notified him in writing a long time ago, before child protective services got involved, you may have a case, buy by waiting you gave the doctor freedom to continue to supply your wife with her addictive meds. It is important to tell your doctor of any abuse of their prescription drugs they are dishing out and the mishandling of your family members possible addition right away. Don't wait! Call his answering service with a urgent call right NOW! Get her fixed, like I said it really wasn't her fault, it was the doctors fault but unfortunately you can't do much about it now that it has gotten so bad. That is what the attorneys will tell you.

I don't believe you can and here is why, a person has to sign a form for the Dr to release medical information to anyone even husbands. But I'm sure if there is a custody issue, your lawyer could use the information you have.

Of course you can sue, but you will have to get other doctors to examine her and testify against this doctor in court.
My bet is it will be hard to prove, and very expenisive, since you will have to pay for all the examinations and the very high price doctors charge to testify in court.

Is there some reason you have not reported him to the state board that oversees doctors?

The underlying problem you will have is that it appears you conspired with him since you did nothing.

You can sue but I doubt you will prevail since you did nothing. "Calling him" is the same as doing nothing.
