I work nights, my daughter is almost 5. Her great-grandparents have kept her while I work since she was 6 weeks old. She has spent about 50% of her time with them and the rest at home. Now we are moving to another town and the greatgrandparents are wanting to take custody of her. I am not an unfit mother. Can they do that?

I am a grandmother. Just want you to know where I'm coming from. If you are working to take care of your child and as you say are not an unfit mother then I would say you have nothing to worry about. Very few homes have mothers not working so there would be a lot of children taken if that was the case. The other thing the courts would look at are the ages. You said these are great grandparents, and if they are quite elderly there is not a chance that the courts would take the child from a good mother for them to raise. BUT please whatever you do remember this little girl knows and loves these people and if you cut them off completely you are not only hurting them but you are also hurting your daughter and even if she doesn't realize it now some day she will and she will resent you for it. It may depend on where you live. I have heard of grandparents being awarded custody, but great-grandparents are usually rather old... too old to properly care for a small child on a permanent basis. I THINK that, if you live in America, states set their own law on that.

No, granparents rights only exist when a parent of the child is deceased. My mother in law tried to pull that crap on us when we were thinking about moving. My children never stayed with her but she still thought she could get custody until she contacted a lawyer

They would have to prove that you are an unfit mother for it to pan out. Your daughter is not old enough to legally make the decision herself either. Try searching under "child custody regulations [your state]" or "[your state] legal resources" for more in-depth info.
