I have 50% legal custody, but no physical custody. I get my son on the weekends for visits. My son is three, and we are in California. If I have 50% legal, but no physical, custody, do I still have to pay child support? I am on SSI (although I would like to go back to work) and my son's dad gets SSI and child-only welfare (cash and food stamps).

I probably should've mentioned earlier that my son's dad and I were never married. Child Support Services contacted me because my son's dad receives welfare for him.

If the state where the divorce was granted is like my own, you are responsible for some portion of the support for that child. This is usually determined by a matrix which will give a total support figure, and you are responsible for your proportionate share. It may be that you could use that to get a break on your share, or more visitation, but this would likely require more court time. Good luck.

If you have been ordered to pay child support by a court or have legally agreed to pay support for your child(ren), even though you only have visitation rights and share custody, child support is awarded to the parent with whom the child lives. Therefore, YES you do have to pay child support.

You have the pay whatever the judge orders you to pay. If your finances or circumstances have changed, you need to file a motion to modify the support order.

u would have to prove u have him 40-50% of the time ...and if u do not then yes u have to pay!!! weekends just do not cut it ....sorry!!!
