The landlord is responsible for fixing the structure, and the renter is responsible for their own stuff. That is why it's a good idea to have renter's insurance.

The upstairs renter for damages done to personal property downstairs and the building owner for damages of the actual structure. That's why we have insurance, right? Good Luck! : )

both maybe..if the person has kids and they put something in it to plug it up then its the parents of those kids but if the toilet is older and has been acting up lately,,its the owers to see to it that the toilet is replaced or at least in good working order.

The landlord my love. AND if it goes to court they will be responsible to replace or pay for your mattress. My grandmother used to be a landlord and you wouldn't believe the crap she had to pay for.
