I think you should talk to the local authorities and tell them what's going on. He sounds abusive; if nothing else controlling. You may even be able to get an interpreter, if necessary, depending on your location. They will likely direct to to your local social services office. They can tell you if you need to and are able to file a protective order (i.e. restraining order).
It certainly doesn't sound as if you or your Mother have done anything illegal, and if he is your step father and a U.S citizen, your Mother probably went through INS for a permanent residence card (meaning she's here legally). I hope you two are able to work it out.

Hello i...t... I would like to help you with this problem. I can be contacted on yahoo as the name posted. If you understand how to search for ther human services agency in the area you live, I know someone there would be able to assist you with this issue. I am deeply concerned for your welfare and you mother's as well. Legally I do not think he can sue either of you. It sounds like he is using that threat as a way to keep you under his control. It sounds to me like your step-father is an very insecure man and feels he must be in control over all you and your mother do. Please seek help from a social services or human services agency in your area as soon as you can.

You are talking about two different areas of law. First of all, divorce law varies form state to state, so you need to consult a local divorce attorney. Second, you immigration status is unclear. It is impossible to say if a divorce would force you and your mom to leave the country. Finally, you did not mention your age and that would have some impact on your ability to move out on your. You really need to consult a local attorney about these issues.

He can't sue you. You need the advice of an attorney, not a stranger on this board.

HE CANT SUE YOU. ALL HE CAN DO IS DIVORCE YOUR MOTHER, IN WHICH CASE, SHE GETS HALF OF EVERYTHING ACQUIRED DURING THE MARRAIGE. NEXT TIME HE SAYS ANYTHING ABOUT SUING YOU, LAUGH AT HIM.
