I'm sorry, I miscommunicated. I actually meant why not legislate in the "domestic" sphere. Why is it that sexual harassment at home is not legislated against but it is the work sphere?

i am not sure i understand the question.

the private sphere is legislated and regulated...interstate commerce, tariffs ect. ect.

Teddy Roosevelt was a bad MF at taking on the Robber Barons of his time.
We have the FDA because of him.

That said private institutions should maintainn some degree of protection as long as they seek no federal funds, or use any federal resources.

Government does. They legislate whether or not people have to wear their seatbelts, pay their taxes ect. Business has all sorts of enviromental regs they have to live with, employment laws, and are taxed.

Other than being able to read your mind I don't know what your thesis is.
