He automatically remains your next of Kin unless you legally change it. If this is what you want then that's ok. If not, I suggest to go to a solicitor and get legal advice. Please bare in mind, you may be getting on with him now, but you don't know whats around the corner.

If u trust him enough to make desicions for u or the best person to get a hold of in case of an emergency then do it...but I always put my immediate family down for next of kin then my hubby....so that way if anything should happen at least someone in my family can help...either passing the message along to hubby or making an immediate desicion just in case he couldn't be reached...seperated or divorced doesn't matter..it's a matter or trust and reliablity.

I would even if I got divorced from my husband. We had a son and I would not want anyone besides my husband his father to tell him if anything bad happened to me. I know that most fathers and mother of their children would have enough respect for the other if something happened to the other to tell them the correct way.
Also, think of it this way. If I died and someone like my brother in law told my son that mommy was not coming back my son would associate his uncle with telling him the bad news. Not that he would not love his uncle anymore. It is like the saying goes Everyone hates the messenger and a child know that their father loves them and there is a different kind of love between the father and or mother and child than and uncle or aunt.

first and foremost, please comprehend that your mom particularly did no longer choose to divorce this guy. It became trouble-free for her to break up - purely approximately automatic for somebody in reformatory. She on no account mandatory his signature. they are married and he's now out of reformatory. He calls all the photos. My wager is that she additionally would not have a will. if it is the case, a number of her sources might immediately circulate to organic and organic babies and a few to her husband - state regulation determines what. the only way you're able to desire to alter any of it is to coach that she filed for legal separation. in case you have a legal replica of that place of work work, then you definately can take that to the funeral living house. as some distance because of the fact the papers, they at the instant are pointless. he's now a widower. No divorce intending is conceivable. BTW, popularity of video wills is iffy in many jurisdictions.

Legally I'm not sure, but if you are separated, you are still married so technically I would think so until you became divorced.
