I'm nearly 11yrs old and my "step-dad" is the only dad I know. I want to have HIS last name instead of the last name of the man who deserted us.

In most states, even if you're not adopted by your step dad, you have the right to change your name. What will happen is you need your parents to go down to the court house with you and file for a name change. They will notify your biological dad, and then you will have to go to court and explain to a judge why you want your name changed. If your "real" dad doesn't have any objections to it - and your mother and step dad want it to be changed, then there's no reason that the judge won't let you.

Depends on the state law where you live, if the law will not let you simply have your step dad adopt you and then you will have the last name.
