There are two minimum wages. There is a Federal Minimum Wage and then whatever your state sets. If your state's minimum is higher than the Fed's, then the state's minimum prevails. Federal Minimum is $5.15/hour. New York's is $6.75. It will go to $7.15 on January 1, 2007.

The New York State minimum wage is $6.75 per hour as of January 1, 2006. It will increase to $7.15 per hour as of January 1, 2007. Any increase in the federal wage above the state rate will result in an increase in the state's minimum wage.
Food Service workers --waiters and waitresses -- who earn at least $2.40 per hour in tips may be paid at a minimum wage rate of $4.35 per hour.

Federal law is less, but the state law prevails if it is higher than federal law.
