I'm in Ontario where the drinking age is only 19. NY State is 21.
So when all the partiers croos the border into Niagara to come to our bars and get tanked. Can they be charged with drinking offences when walking back across the border to there home town? Just curious.

Killer. Sorry. I beg to differ.
My buddy who lives in Lockport NY got a real hassel heading back home after a night of NBA finals and beers at Boston Pizza bar'n grill on Clifton Hill in Niagara.
He got fined. That was all. But he was really inebriated which prompted me to ask this question.

They park in Niagara NY and walk across. Then we watch the game...party...and they go home :-)

Yes, they can. I had classmates that got charged with DWI, underaged drinking, and possession of alcohol that they bought up in Montreal where they were legal, but coming back into VT it was illegal and they lost their license, were fined, and spent a night in jail.

They wont be charged when they are walking over the border (after all, that in theory is impossible). If they are found drunk, they will be arrested on Canadian soil, which gives custody to Canadian authorities.

With that in mind, Canadian authorities can then do what they see fit. Remember, they have to right to refuse entry to the United States. They will probably be handed over to United States Customs officers and placed in a holding cell for the night until they sober up.

Yes, the US has a Zero Tolerence Law. Anyone under 21 caught with any alcohol in their system gets charged.

They're just a bunch of happy drunks who have found a way to bypass the neo-nazi anti drinking laws of the puritanical US.

Lol, the American public school system doesn't care about our peaceful friends north of the border. I'm serious, I haven't learned anything about the provinces or the imports/exports of the great north land Canada. They do teach world geo. but not about Canada!! I bet you they teach american crap to you guys up there. Sorry.

Stupid question. Why will they be charged if they did not drink at an American Bar. America does not have jurisdiction over what happens in Canada. Unless you are driving NOT walking to America.

They won't bother you as long as you behave yourself. My brother would drive home across the border tanked. We live in US

If you are caught drunk in public in the USA, how can you prove where you've been drinking. They will get you for underage drinking on their jurisdiction

if driving drunk back to U.S. they could still be stopped for DUI ...... also drunk & disorderly conduct might apply if they showed poor behavior in public
