My friend is in jail, I just heard today. I heard "sexual misconduct W/ a minor" what does that mean he did? he is 18 and has a record of Substance abuse, he is on Parole. We live in Michigan. How much trouble could he get in, I think the girl was under 16...... what does that mean he did? What constitutes "sexual misconduct with a minor?"

I have no background in Michigan law, only Illinois, but the underlying concepts are similar in general.

When both of the parties involved, the perpetrator and the victim, are in their teens, the authorities don't look so harshly on this as if the guy were 40, say. So they take what is essentially Statutory Rape, and soften it down to something like "sexual delinquency", or as you write, "sexual misconduct".

The guy will probably get into more trouble because of his parole violation, than for this minor sexual peccadillo. That could mean some jail time.

There are also usually some kinds of counseling that kids can be sent to, involving family and sex responsibilities.

SMWAM is vague--any kind of sexual, oral, or other intimate contact could be included, with or without the girl's consent. Since she is underage, her consent is irrelevant; even if she was a willing participant, sex is not supposed to happen between persons on opposite sides of the age of majority.

And different states define that age differently--maybe 21, maybe 18, maybe 16. A flaw of our laws is that there is no national standard for :"At what age is someone a full adult"? For tobacco there's one age; for alohol there's another; for sex, still another; for military service or voting another, etc. etc.

Heya Liam! In Asian Buddhist culture this would mean strict morality. In Western Buddhism this means behave in a decent and considerate way sexually, and make thoughtful and wise sex choices. The reason for this precept is so that sex doesn't distract from meditation too much by creating guilt, shame, fear, anxiety, longing and so on. The idea behind the precepts is to simplify life. Asian Buddhists can be a little bit anally retentive about the precepts and I have found East Asian Buddhism has a distinctly totalitarian flavor. I recommend avoiding Goenka, a Burmese Buddhist group, because it's not compatible with Western freedoms.

That means he did something of a sexual nature with a minor, or that he is being accused of that anyway. It really depends on your State laws. Here in Nebraska that's worth up to 50 years in prison. Good luck.

Sexual misconduct generally means he touched her where he shouldn't have. It is not the same as statutory rape.

(confused this with another question about Pennsylvania)
