when I called police he left the scene and later he was arrested. My dad had to go to police station and an police officer interviewed my dad and the guy. The officer told us that the guy has been charged with assault, but the guy is making an allegation on me that I threatened him to kill, and he had to ran away... When I heard a phone call from my mom that the guy is beating dad, I ran to the place and when I saw blood on my dad face I got so upset I tried to go after him but mom and my brother was stopping me doing that only I swore to him using F..words. What should I do with this allegation which I don't remember saying that? (somebody is beating my dad and there is blood on my dad face, It hurted me a lot. No other son would stand there say nothing or do nothing)
ps: I just found out that the guy has hired a defence lawyer.
I or my family can't not forgive what he done to my dad. I can't not let him get away this without any punishment. What should I do?

First of all, calm down and take a couple deep breaths. Now:
He hired a defense atty? Good for him. Don't worry about it, it's commonplace in the court system.
Does he have any witnesses to this allegation? Even so, if you said anything of the sort in reponse to seeing your Dad hurt, he doesn't have a leg to stand on. You were in a traumatized state. Remember that. So long as you didn't hit him or manage to injure him in any way, I don't see you getting in trouble for yelling at him. Have the police taken any action against you? If not, then there's your proof that you have no worries. His defense attorney may try to throw some garbage in on the case, but his best bet is to plea bargain and get out there. Does this guy have a record? If so, he needs an attorney to keep him out of a term in the slammer. I don't think he's going to get away with it and I don't think you have anything to worry about. Just take care of your dad. Let me know if I can look something up for you.

Have you been charged with a crime?
If so, keep your mouth shut until you talk to a lawyer. You do not need to say anything further to anyone and if you do so, it will only hurt you, not help you.
Most states provide for provocation as a defense, so it is unlikely a prosecutor would prosecute you for attempting to defend someone, especially your dad. Or, prosecute you for what was in reality an emotional outburst, not a crime.
But, in the meantime, keep your mouth shut.
Anyone who takes the law into his own hands is a criminal and if you do so, you will be a criminal.

First of all, I hope that you did not give a complete report to the police. Whatever you say can be held against you and made to appear like something else happened.
I hope that you did not have a weapon.
You need an attorney's opinion. Assault is very serious and you should have a professional examine your liability as well.
Best wishes.

even if you did indeed threaten him, any descent defense attorney can defend it as heat of the moment issue and thus will nullify your coments, the physical assualt on your father is harder for him to explain away, and thus is a slam dunk case for the prosecutor, he is just saying such statements to divert attention and penalties he faces for the assult, juries can see through his guise and as long as you tell the truth you will have no problems

That guy would attempt to plea good deal, yet he will definately get some variety of punishment out of it. as far as his aligations of you, i does no longer difficulty about it in any respect. there is not any evidence of it. The police received't take him heavily both because of what he did for your dad. he's probable in simple terms attempting to get absolutely everyone in problem because he's.

Nothing you can do, let the law do it. If you go to court, just tell the truth.
