You put a man in a coffin like cell with senses all controlled and with occasional beatings and torture,what would you do?When you are a suspect you are innocent until proven guilty.or does that applies only to Americans. Then again even if they are guilty they are never sent back to the country where the crime was originally commited? With all that in mind what would you do?"That is an act of war" so say the moron with no heart.

As much as i would like to accept opinions, would it be too much to ask for some unbias logic? They whom you have judged as killers are not proven guilty yet, and until that happens they should be accorded their rights as a human being first, never mind the unproven accusations, which until proven are just suspicions

How convenient to do some acts of kindness to cover all your crap beginning with robbery of the country you call home, How easy to hold the world at ransom with your culture. How easy to control the world with your lies and deception and how easily your government issue orders to go to war without the UN mandate and arrest so call terrorist to put them in jails outside your country to avoid publicity from the small number of activist who has the decency to do something about it, my life is too short to worry about the web of lies but is it too much to ask for the truth or has honesty along with the other values espouched by the Us gone down the drain. It takes a lot to cover up you lies and we are not all blind all the time. How about world democracy, one person 1 vote since you preach democracy, would you dare do it? No you won't, why? It is only applicable to people like yourself who have installed yourself as police of the world and we are just to follow all your policies? 2006????.

I'm not weighing in on all the pros and cons of the Gitmo camp, nor am I evaluating whether or not the constitution applies to the Gitmo detainees or the permissions granted to Homeland Security to bypass certain parts of the constitution.

I just want to make a couple of remarks.

The detainees in Gitmo who are true combatants and/or are members of al Qaida, and/or are Talibani, and who are not American citizens have no protection under the US constitution. If they hold US citizenship, but were captured as combatants, they forsook that citizenship and are legally considered traitors as well as enemy combatants. If there are US citizens detained at Gitmo and they are not al Qaida or Talibani, and were not enemy combatants, and were not captured in war zones of Afghanistan and/or Iraq, then they may have recourse to due process under constitutional law .

However -- under Homeland Security and all the powers we granted to the department, constitutional due process is allowed to be suspended so long as it can be shown that a detainee does or did present a threat through action or conspiracy.

In short, we the people have said that in order to pursue the "war on terror," we will allow certain suspensions of and allowances or leeway in interpretations and applications of constitutional law including due process, habeas corpus, and much, much more.

Now, as I said, I am not saying anything about what is right or wrong about anything involved in these issues, in terms of the constitutionality of many things done in the name of Homeland Security and the war on terror.



I see it as unfortunate if Gauntanamo detainees chose suicide as an alternative to despair over their situation; however, only in so much as I feel regret over any needless death. Furthermore, if their despair was due to their being frustrated terrorists or captured combatants in any ongoing war, I feel no sympathy whatsoever for their despair in that case.

If any or all sought to garner attention for their cause as detainees, I regret their choice of method.

However, if any or all sought to muster support for their agendas as terrorists or combatants, then I hold them in the same contempt as I do their brethren, the suicide bombers who used their deaths to try to further their campaign of terrorism.

Last, and I know this sounds cold, but I feel much better knowing that a suicide died alone rather than taking others with him, like bombers are doing every day.

P.S. In times of war, it is customary to hold prisoners so long as hostilities continue, therefore it is entirely arguable that as so long as hostilities continue in Afghanistan and Iraq, then repatriation may be denied. By extension, in the case of al Qaida members, as a group who declared war on the US and as a group without a nation, they present a special case wherein "repatriation" and "end of hostilities" are indeterminable by previous or traditional means and practices.

Do you want to return avowed enemies of the US to a status of active combat against us?

I find it scary that people will rationalize any act of depravity because they identify themselves as a "republican" (people think human rights is a mere statistic in a sports game). Grow up- you know you would react differently if the same thing happened to americans so how about using independent thought?? I mean, there could be a pic of american soldiers putting a living child's head in an oven, and some people would still find a way to justify it- "he was going to be a terrorist" etc. Have you no conscience? The same type of person who, had you been alive during 1930s Germany, would have blindly followed those evil orders. Who's "good" and who's "evil" I can't tell anymore when I hear dupes like you, jeff.

I think everyone is entitled to having a fair trial, The United States Government is wrong to lock anybody up without trial. If the American Government is so sure that these people are guilty then why can't it be proved in a court of law - some of these people have been locked up for over four years, surely some evidence that would stand up in court must have been found by now!

Anyway, how can killing yourself be an act of war?

I dont quite see how washington could even think of these as an act of war. How is suicide an act of war? I'd think locking up potentially innocent in appauling conditions and even worse treatment was more of an act of war than suicide. This is why so many people are anti america; because they are setting a double standard. Its alright for america to torture people, but not for sadam? If any other country had a guantanamo like prison, america would be the first to order its shut down.

Well here's another degenerate who knows everything. Why do you think those so called human people are in detention in the first place? All you people do is place the blame on the United States when our people are trying to help other people around the world. We did not commit an act of war crashing planes into well populated buildings, killing thousands of people. I personally didn't agree going to battle with a country who was under a dictator who was murdering thousands of his own people, but that is why we elect our government officials and they are the ones who decide this for us. and we certainly don't fall back on our books of teaching others to kill themselves for religous reasons that don't even make sense. I don't understand your reasoning but then again you don't understand ours as a free country either, so before you open your mouth blowing hot air, I suggest you learn more about what's going on first, and above all, know the people your condeming under your thoughts.
P.S. I'm not afraid to mention what country I live in, why don't you?

From interrogation methods that include extreme physical and psychological abuse--including sexual humiliation and mock drowning--to guards’ reported desecration of the Koran, to brutal force feedings, prisoners have suffered well-documented abuse at the hands of their jailors.

Just last month, the United Nations Committee Against Torture called for Guantánamo to be closed--in part because of the detrimental effects of prolonged detention and inhumane interrogation practices on detainees’ physical and mental well-being.

Today, an estimated 460 prisoners remain at the camp--several of whom were under the age of 18 when first brought to Guantánamo, a clear violation of international law. So far, just 10 have been charged with any crimes and are slated to have their cases heard by military tribunals.

If this is fighting a war on terror, count me out, you people who support this are Nazis, plain and simple.

HOLDING PEOPLE HOSTAGE IN CUBA IS WRONG.
iT IS NOT AN ACT OF WAR simply the idiotic means by which our government has handled the sittuation .As all things in government they take time everyone needs to get there story straight before anything can be done.
I forsee large court settelments used by angry detainees to pay for weapons to be ussed in the future against us.
I also told people years and years ago not to give other people guns planes and bombs that they would be used against us and they are .
the best thing we can do is disarm ourselfs and ask GOD to protect us and get rid of our military all togheter it only gets us into trouble ask the world to forgive us and move on to more important things like saving a million lives each day that are being killed starvation and simple medical problems that can be fixed with a shot.

if the us is so certain of the guilt of these "illegal combatatants" put them on trial with a proper judicial authority for the world to see.

What has america got to fear about giving these people a fair trial, oh thats right, for many there is no evidence against them and they have been picked up from towns unrelated to military actions. Is being a muslim with a beard in a Muslim country a crime worthy of detention these days?

From what I see the suicides were an act of desperation. How can you hold all these people with no charge after so many years? Prove that they are guilty and sentence them but holding them against their will, with not enough evidence is crazy.

Who admits to supplying $6 BILLION to the Taliban and other terrorist?....oh that right it was the US!

Thank God there's people in the world that know what needs to be done and aren't afraid to do it. For the rest of you who believe the answer is, "Reach out and hug a terrorist", I invite you to go over to the Iraq, Afghanistan, Mogadishu, the remote areas of Pakistan. Reach out to these people and show them you really care. I will even pay to transport your coffins back home.

It's real easy to sit at your pc, safely behind your momma's locked door and criticize people that aren't afraid to do what needs to be done.

If it were me, I'd give them all ropes in Gitmo if that's what they want.

It's silly spin and even some of the inbreds answering this have fallen for it.

If they're terrorists and want to kill us then put them on trial! No excuses about "what their countries would do to us" or pics of 9/11 - if they're so guilty then let's see it - give them a fair trial!
