In my trial, my witnesses are: Wendy Kay, Customer at the jewellery and john summers ex wife. The people against me are going to bring a criminal record of the ex-wife to prove she's fraud and a criminal and the judge won't believe she's telling the truth on the stand.

First, see if you can't get her criminal record suppressed so that the jury can't see it. If not, then rehabilitate her on the stand. Ask her questions that will establish that she has been a good upstanding citizen since then. For example:

Ms. Kay, how long ago did such-and-such happen?
--four years ago

Since then, can you tell us about your life?
--Sure. I make AIDS quilts, I volunteer at rest homes, I walk neighborhood dogs, I've held a job at Jewelry Store X and my boss has no complaints, I got Employee of the Month for being such a good worker, etc. etc.

Have the Boss come in and testify that the witness is a great person.

You don't need to worry what the Judge thinks--you need to worry what the jury thinks. Don't try and hide anything, confront it, show she's changed and regrets her actions, and move on.

If her testimony is supported by the other witnesses then the record should not unduly affect her credibility.

On the other hand, you might decide that the other two witnesses are enough, and decide not to use her.

It depends on what she is going to testify about and how important to your case it is.

alot of times the courts don't really want to bring something to trial if it is something you can make a deal on try that a judge is a judge let him decide if the witness is credible or not okay?

Don't put her on the stand and get some more character witnesses.
