I saw the question about burning the flag, and while interesting, I thought it was worded wrong.

When you buy an American flag, it is your property...agree or disagree?

And if you say the American flag is community property..isn't that really code for collectivization (which is a communist idea)

And if you agree it is your property, don't you have the right to dispose of it the way you wish..up to and including making a political statement..IE burning?

I'm not saying I approve of flag burning..

But..keeping in mind..freedom of speech, and freedom to dispose of your own property..even if it an American flag..

Don't you think that a constitutional amendment banning the burning of the flag..abriges property rights and free speech rights..which is what America is partially based upon?

Hte flag belongs to the American people and so does the constitution say, if someone insults the flag is insultting all the Americans.

You are mostly correct. A ban on flag-burning does seem to restrict a few of our cherished freedoms in theory. A detail you missed, however, is the observable fact that the Constitution has not been in effect for over a hundred years. First, as a species of contract law, the Constitution was not really enforceable after the deaths of the Founding Fathers, and may not have even extended to their own families (reference below). Secondly, after FDR declared a state of emergency in this country while in office, which no administration has ever lifted, constitutional law has in a certain sense, been suspended. Thus, no rule of law. It's all a plot!

fist of all... i am all for freedom of expression--or freedom of speech-- BUT--flag burning should not be allow !!!!! Our flag is a symbol of America and it should be treated with respect!!!!!! Thousands of people have die defending what it represents !!! when our flag is burn in the middle Easts it is not burned because it is a piece of cloth it is burned for what it represents ......now those people that claim that burning it is their freedom... i guaranteed you that most of them have never defended it or what it represents on a foreign soil because if they have they would not even consider doing it((burning it)).....When you are thousands of miles away from home (The USA) some times that is all you have that reminds you of home---sooo i truly believe that the flag burning is wrong and shouldn't be allow any where in U S soil under any circumstances!!! -------If you are a true American let me suggest you reading some very touching stories about what our flag represents i garanteed you will drop at least a couple of tears ---read chicken soup--4- the veteran soul...and if after reading those stories you don't defend our flag you are just toooooooooooooooooooooo liberal!!!!!

Its the same as all countries, but lets not get carried away. If people want to burn your flag, let them, that is their right. The day a nation worships a flag, and not a nations values, is the day Nationalism rears its evil head. A flag is just that, a piece of coloured cloth representign a piece of dirt in which we live...Dont get carried away by it

i do believe that even if you bought something like a nations symbol, it doesnt mean that you're the only person who owns it. There is still a part of everyone in it even though you legally own such a thing, and I do think that burning or disposing of such material is not right bcoz not only does it demoralize a nation, but it also shows weakness of discrepancy w/in a society

I would say that while, there is no clause in the constitution.
that it would belong to all of us collectively and seperately.
I think the reason for the amendments is to take focus from wrongdoing.
so therefore get everyone to think on something else.

If you use that logic, there should be no speed limit on highways, because you can use your car however you want. It wouldn't be a matter of property rights, it'd be a matter of free speech.
