Divorces are a dime a dozen. You can get a divorce on the grounds of spousal abandonment (as long as yiu didn't marry this character while he was in jail already). You can call legal aid in your area for free or low cost representation. Or get one of those yahoos in the yellow pages who will offer quickie divorces for like $50 bucks.

Going to prison is grounds for divorce in most states.
Most states have "no fault divorce" and you don't need a reason or his agreement.
Indigent people can file an affidavit called "Pauper's Affidavit" and the court should allow the suit to proceed at no cost to the litigant.
You should be able to get specific advice from your local legal aid society. They will be listed in your local phone book (assuming you live in a city).
Since you have children, a divorce will involve more than filing forms, you should seek legal advice before proceeding.

In NJ you can use a company called The divorce Center. They have a website. It costs like $500 and another $300 in court recording fees. You have to fill out a huge questionairre and they prepare all the docs for you. You file them with the court yourself which is easy and attend court by yourself. It's no big deal. Works like a charm. Good Luck.

It depends upon your state. Go to your official state website, and look for a link that says something like "LEGAL". Go there, and look for links to self-help. You can also do a search on most state websites using the word "divorce". Once there, you ought to be able to find the paperwork for fill out yourself for a divorce.
Alternatively, some communities offer low-income legal aid.

Nearly every city or county has a legal aid organization of some sort. They can help you get it done. If you cannot find one, try contacting one of the local organizations that helps battered women. They will most certainly know someone who can help you. And, if that doesn't work, call the court clerk of your local civil court and ask him or her. Good luck!
