have offered to surrender the car...but am moving next week can they pick up the car in florida?

Hi there. I edited a few books on bankruptcy several years ago. From what I recall, your answer depends on if you owe any money on the car (is it still financed) and did you exempt it from your list of assets in your bankruptcy filings?

If it's still financed and you exempted it (meaning you intend to go ahead and pay for it) then you shouldn't have to turn it over to the court. If it's paid off and you included in your assets to forfeit, then you probably have to do that before you leave the state. Either that, or go ahead and make your move and then return the car to your court asap. You can always fly back to Florida.

I would call your attorney and ask him/her before you do anything else. You may find you can keep it. In some states, you're allowed to keep one vehicle provided you listed it as an asset when you filed. You may also find your vehicle has no seizure value for the court, in which case, they won't bother to take it.

no you cann't if you filed chapter 7 in your state your not allowed to keep the car then surrender it in another state you have to surrender the car in your state it's the law

What car do you have?

Perhaps I can buy it and you use the money to pay your car debt to the bank.
