We live in South Australia, the debt is in my husbands name so can they touch property, possesions, that are in joint names?

The seven years that you guys are talking about is the time allowed to keep a dept showing on your credit report, the statue of limitations is different in each state in PA its four years,BUT if the collection agency calls after the four years and you admit to owing the dept then the statue starts all over again. As far as Australia goes I have no idea you would have to do a search on the net for laws governing your area.

they can touch joint owned possesions but most debt collectors sit and wait for you to buy a house...like we did. we bought our house this year and a debt showed up on my wifes credit history check that stopped us from buying untill it was paid off...the debt was from 15 years ago...it was for $8000, we called them and offered to pay them 5 cents on the dollar, and they accepted.
